Germania bankruptcy procedure

On 04.02.2019 the airline filed for bankruptcy at the district court of Berlin-Charlottenburg: https://www.berlin.de/gerichte/amtsgericht-charlottenburg/  According to Germania, package travellers can contact their travel agent to organise a substitute transport. Passengers who have booked directly with Germania do not have such a possibility. What those affected need to know.


Insolvency of an airline – What can consumers do?


Passengers who have booked their flights directly with Germania will have to bear their costs, as claims arising from flight cancellations, delays or loss of luggage, for example, can no longer be refunded or compensated directly by Germania. Once the bankruptcy proceedings have been commenced, passengers can file their claims with the competent liquidator. Preliminary liquidator is Rüdiger Wienberg. https://www.hww.eu/germania/



What those affected need to know now:


•             Eurowings, easyJet, Condor and TUIfly offer special conditions for affected Germania passengers.

•             The conduct of the insolvency proceedings is unknown at the moment. Consumers should be aware that it will be difficult to get their money back from Germania. Passengers of bankrupted airlines usually get nothing.

•             Passengers who booked their flights directly with Germania are not entitled to substitute transportation.  

•             If a flight was booked via an intermediary, e.g. online booking portal or travel center, the claims only exist against the airline. In this case, the intermediary is the contact, but the intermediary is not liable for claim. Nevertheless, those affected should contact the intermediary. The intermediary may refund the ticket purchase price if the purchase price has not already been transferred to the airline. 

•             Passengers who have booked a package travel, e.g. flight and hotel, can file their claims with the travel agency. The travel agency has to arrange substitute transport.

•             Passenger who have paid the ticket purchase price by credit card should check their credit card terms and conditions for possible insolvency protection.
